General terms and conditions of business

GENERAL TERMS AND CONDITIONS

1. Unless otherwise agreed in writing, the following General Terms and Conditions shall apply exclusively. Any comments to the contrary by the other party must be accepted in writing and relate only to the present order. The customer is aware that with his order he accepts the present general conditions.
2. Complaints must be sent to us by registered mail within 8 days of the invoice date. A properly submitted complaint does not release the customer from his obligation to pay our invoice in its entirety.
3. Driving lessons which are not cancelled by the student at least 48 hours before the agreed date can be charged by Homburg pGmbH with 50% of the price of the driving lessons not cancelled in time.
4. Driving tests which are not cancelled by the learner driver at least 72 hours before the agreed date will result in a charge of 25 Euros recourse payment to the driving test centre and a charge of 50% of the presentation fees of Homburg pGmbH.
5. Our invoices are payable net on receipt without discount. Interest of 15% per annum shall be charged by operation of law and without notice of default on invoices not paid in due time. Any delay in payment of invoices will be made with a compensation of 20% with a minimum of 62.-€ on all outstanding amounts, recognized by the customer on the basis of the Civil Code articles 1147 and 1152. We retain title to the delivered goods until all claims to which we are entitled from the business relationship have been settled in full.
6. The competent jurisdiction is Eupen.
